3. How do we use the information we collect?

3.1. We may use the information we collect about you:

(a) to improve the Platform, our products or services, to customise your experience on the Platform, or to provide specific content that is most relevant to you;

(b) to contact you about changes to your use of the Platform and any adjustments we may make to the Platform and/or Platform policies at our discretion;

(c) for internal business purposes;

(d) for the purposes for which you provided the information or as otherwise set out in this Privacy Policy;

(e) to provide you with information, products or services that you request or consent to receive, or to process transactions, including sending electronic newsletters or providing marketing materials;

(f) to enable you to participate in various features of the Platform;

(g) to process your registration on the Platform, including verifying that your information is active and valid;

4. Do we use your information for marketing purposes?

4.1. To the extent permitted by law, we may use your data to contact you electronically (by email) with information about products, events and services that may be of interest to you. If you do not wish to receive such information, we will provide you with the opportunity to opt out.

4.2. We may allow selected third parties to use your data to contact you by email with information about products, events and services that may be of interest to you, provided that you have consented. If you do not wish for us or third parties to use your data in this way, please notify us of your wishes by email or through the forms on which we collect your data.

4.3. Subject to your preferences, we may also contact you by telephone or standard post.

5. How and when do we disclose information to third parties?

5.1. We may share the information we collect about you, including personal data, as follows:

(a) We may engage third-party services to assist us in certain areas, such as email marketing, call centres or website hosting. In some circumstances, third parties may receive your information;

(b) We may share information with parent companies, subsidiaries and affiliates for internal reasons. In addition, to the fullest extent permitted by applicable law, we may use IP addresses to identify users and may cooperate with third parties such as copyright owners, internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion. Such disclosures may be carried out without notice to you to the fullest extent permitted by applicable law.

6. What about my own user-generated content?

The Platform may allow you to submit ideas, text, data, questions, comments, suggestions or other content, including personal information (collectively, “User Content”). Please note that such publicly posted content is not confidential. User Content may be copied, published, distributed or otherwise used, online or offline, by us or others in any media or format currently existing or developed in the future. Others may be able to access this User Content and be able to share it with third parties over the internet. Please think carefully before deciding what information, including personal data, you share in connection with User Content. Please note that we do not control who will have access to information that you choose to make public, and cannot guarantee that parties who access such public information will respect your privacy or keep it secure. Our obligations under this Privacy Policy do not apply to any information that you publicly disclose, share with others or otherwise upload onto the Platform. We are not responsible for the accuracy, use or misuse of any content or information that you disclose or receive through the Platform or from third parties.

7. How do I change my information and communication preferences?

7.1. Upon request, we will delete your personal information from the Platform and/or our databases. Users should also be advised that, upon written request, you may access and/or request correction of any inaccurate information we hold about you.

7.2. You are responsible for maintaining the accuracy of the information you submit to us, such as the contact details provided at registration.

7.3. You may cancel or modify the Platform communications you have opted to receive by following the unsubscribe instructions in the relevant emails.

8. What about third-party information collection technologies?

This Privacy Policy does not apply to applications, technologies or websites owned and/or operated by other parties (such as application developers, third-party advertisers or third-party ad servers), even if they use our technology to collect or store information. This includes third parties that embed our technology in their applications or advertising to facilitate download tracking or serve advertisements. However, we work with third parties to ensure that you are provided with the necessary information and have the opportunity to make choices. You should review the applicable third parties’ terms of use, privacy policies, permissions, notices and settings to understand their collection, storage and sharing practices.

9. What about security, storage and international transfers?

9.1. The Platform and information are stored on host servers located in the United States.

9.2. We use commercially reasonable safeguards to help protect and secure your personal data. However, there is no guarantee that transmission of information over the internet, wireless transmission or electronic storage of information will be secure.

9.3. When you register on the Platform, you may also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use another user’s account, username, email address or password at any time, nor to disclose your password to any third party. You agree to notify us immediately if you suspect any unauthorised use of your account or access to your password.

9.4. Please note that the information we collect, including your personal data, may be transferred to, processed and stored outside the European Economic Area. The data protection laws in these jurisdictions may differ from those in your country, and your personal data may be subject to access requests from governments, courts or law enforcement in those locations. We take commercially reasonable measures to ensure that your data is treated securely, including by putting in place appropriate data transfer agreements. We may also share personal data as described below:

with other group companies where necessary to fulfil the purposes for which you provided the information; and with third-party agents and subcontractors to whom we transfer business, who perform certain functions on our behalf, such as sampling and delivering samples, fulfilling and checking orders, sending emails, removing repetitive information from customer lists, analysing data and processing credit card payments. These parties are authorised to receive the relevant information only as needed to perform their functions and may not use it for any other purpose.

10. How long do we keep your data?

We will only retain your personal information for as long as necessary to fulfil the purposes for which it was collected, including to satisfy any legal, accounting or reporting requirements. When determining the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your information, the purposes for which we process your information and whether these can be achieved through other means, and the applicable legal requirements.

In some circumstances, we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

11. What about changes to the Privacy Policy?

We reserve the right to modify or add to this Privacy Policy at any time without prior notice (the “Updated Privacy Policy”). You agree that we may notify you of the Updated Privacy Policy by posting it on the Platform via a link on the homepage, and that your use of the Platform after the posting of the Updated Privacy Policy (or such other action as we may reasonably specify) constitutes your agreement to the Updated Privacy Policy. Accordingly, you should review this Privacy Policy before using the Platform. The Updated Privacy Policy will take effect as of the time of posting or the date specified in the Updated Privacy Policy and will apply to your use of the Platform from that time.

12. What are your rights?

With respect to the information we hold about you, you may:

• ask for a list and description of that information to be provided to you;
• request that we correct any inaccuracies;
• ask us to delete your information by contacting us as set out below;
• object to the processing of your information where we rely on legitimate interests (or those of a third party) and there is something about your particular situation that makes you wish to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes;
• request the suspension of processing of your personal information, for example if you want us to establish the accuracy of the personal information or the reasons for processing it.
• request the transfer of your personal information to another party.

If you are not satisfied with our response, or believe that we are processing your personal data unlawfully, you may lodge a complaint with the relevant authority.
